Terms of Service

1. What Videoyn is

Videoyn is an AI video generation service operated by Ryan Moffat ("we", "us"). By creating an account or using the service you agree to these Terms of Service. If you do not agree, don't use Videoyn.

2. Your account

You must be at least 18 years old to use Videoyn. You're responsible for keeping your sign-in email secure — we authenticate via magic links only, so anyone with access to your inbox can sign in. We don't store passwords.

3. Credits & subscriptions

Generations are billed in credits. Each tool lists its credit cost before you run it. New accounts start with 5 free credits. Paid plans renew monthly or annually via Stripe and grant a fresh credit balance on renewal — unused credits roll over according to your plan's rules (Pro: 1 month, Studio: 2 months, others: no roll-over).

You can cancel a subscription any time via the billing portal on your account page. Cancellation takes effect at the end of the current billing period; you keep access until then. We do not issue refunds for partial months, but if a generation fails on our end we automatically refund the credits spent.

4. Ownership of generated video

You own the videos you generate on any paid plan and may use them commercially (ads, social, retail, client work). The Free tier is personal use only — no commercial usage while on Free.

You're responsible for the inputs you feed into Videoyn. Do not upload content you don't have the right to use, including images of people who haven't consented, copyrighted artwork, or trademarked material.

5. Acceptable use

Videoyn is designed for lawful creative and commercial work. You agree you will not use the service — via prompts, uploaded source images, or any other input — to generate, attempt to generate, or distribute any of the following:

a. Child sexual abuse material (CSAM). Any sexual or sexualised content involving anyone under 18, real or generated. This is a hard, non-negotiable prohibition. Accounts that attempt it are terminated immediately and reported to the relevant authorities, including the Internet Watch Foundation and the police.

b. Non-consensual intimate imagery.Sexual, nude, or intimate content depicting an identifiable real person without their explicit consent, including "deepfake" imagery. This is a criminal offence in the UK under the Sexual Offences Act 2003 and the Online Safety Act 2023.

c. Hate, harassment, and incitement. Content that attacks or dehumanises a person or group based on race, religion, nationality, sex, gender identity, sexual orientation, disability, or any other protected characteristic. Content that incites violence or harassment against an individual or group. Relevant UK law includes the Public Order Act 1986 and the Racial and Religious Hatred Act 2006.

d. Impersonation and deception.Content designed to deceive viewers into believing a real, identifiable person said or did something they didn't. Public-interest satire is allowed if obviously so; fraud, defamation, and misrepresentation are not.

e. Violence & harm. Gratuitous, graphic violence; content glorifying terrorism or self-harm; instructions for making weapons, drugs, or other items illegal under UK law.

f. Other illegal content.Anything else that breaks UK law or the law of the jurisdiction you're operating from, including fraud, copyright infringement beyond fair use, or breach of export controls.

6. Moderation and enforcement

We operate an automated content filter that screens prompts and uploaded images before generation. Blocked attempts are logged, including the nature of the block and the account responsible, for audit and legal compliance purposes.

We may suspend or terminate accounts that violate the Acceptable Use rules above, with or without prior notice. We may cooperate with UK law enforcement where required — including proactive reporting of suspected CSAM to the relevant authorities.

If you believe content you generated was blocked in error, email hello@videoyn.comwith the prompt text and context and we'll review.

7. Service availability

Videoyn is provided "as is". We aim for high availability but make no uptime guarantees. GPU capacity is shared; generations occasionally queue or fail. We don't warrant that the service will meet your specific requirements.

8. Liability

To the fullest extent allowed by law, our total liability to you is capped at the amount you paid us in the 12 months preceding the claim. We're not liable for indirect, consequential, or incidental damages — lost profits, lost data, business interruption, or similar.

9. Changes

We may update these Terms from time to time. Substantive changes will be emailed to account holders. Continued use after changes take effect counts as acceptance.

10. Governing law

These Terms are governed by the laws of England and Wales. Any dispute is subject to the exclusive jurisdiction of the English courts.
